Terms of Service

These terms govern your use of alithicai.com. They are written to be readable rather than impressive; if anything here is unclear, ask before relying on it.
1. Who These Terms Cover
These terms apply to everyone who visits this site. If you are a paying Alithic client, you have a separate signed Service Agreement. Where that agreement and these terms disagree — on pricing, service levels, or liability — the Service Agreement wins. What happens to information collected through this site, including cookies and the Meta advertising pixel, is covered by the Privacy Policy rather than by these terms.
2. What Alithic Does
Alithic builds and manages AI voice and chat agents for small businesses. Every demo, transcript, dashboard, and call log on this site is illustrative. None of it is real client data, and none of it is a recording of a real customer call.
3. Using This Site
Use the site lawfully. Do not attempt to break, overload, scrape at scale, or gain unauthorised access to it, and do not use it to send anything unlawful, abusive, or infringing.
4. The Chat Widget
The assistant on this site generates its responses automatically. Its answers are informational only. Nothing it says is a binding quote, a contract, or a guarantee of price, timeline, or capability — those come from a written proposal or the Service Agreement.
5. Emergency & Urgent Situations
Alithic’s agents — including the demo on this site — are not equipped to handle emergencies and cannot connect anyone to 911 or local emergency services. If a caller or chat visitor describes what sounds like a genuine emergency, our agents are built to say so plainly and direct them to contact emergency services directly. We cannot guarantee every caller will do that, and Alithic is not liable for a caller’s decision not to seek appropriate emergency help.
6. Intellectual Property
Alithic retains ownership of the underlying technology used to build and run agents — the tooling, prompt architecture, and infrastructure. Configuration and scripts written specifically for a client are licensed to that client for the duration of the engagement.
7. Confidentiality
Information a client shares in order to have an agent built — call recordings, scripts, pricing, customer details, operational specifics — is treated as confidential and is not disclosed to third parties except where required to deliver the service or by law.
8. Your Compliance Obligations (Clients)
If you are a client, you are responsible for making sure your own use of the Services — including who your agent calls, texts, or messages, and what consent you have obtained to do so — complies with the law that applies to you, including telemarketing and messaging rules like TCPA in the US or CASL in Canada. Alithic builds and operates the agent; you control who it is pointed at, and that responsibility does not transfer along with the technology.
9. Disclaimers
The demos on this site show how an agent handles a scripted scenario. They are not a performance guarantee. Real-world results depend on call volume, the quality of your intake process, and how your business handles the bookings the agent creates.
The site is provided as-is, without warranties of any kind to the extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, Alithic is not liable for indirect, incidental, or consequential losses arising from use of this site or the Services. Where a liability cap applies, it is limited to the greater of the fees you paid Alithic in the 12 months before the claim arose, or a small fixed amount stated in your Service Agreement.
11. Termination
Access to this site may be withdrawn at any time. Termination of a client engagement is handled under the Service Agreement, not under these terms.
12. Governing Law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
13. Indemnification
You agree to indemnify and hold Alithic harmless from claims, damages, or reasonable legal costs arising from your misuse of this site or violation of these terms. Alithic agrees to do the same for you against claims that Alithic’s own underlying technology infringes a third party’s intellectual property rights — each party stands behind the part of this relationship it actually controls. For clients, indemnification obligations tied to the Services themselves are set out in the Service Agreement, not here.
14. Dispute Resolution
Before pursuing formal action, both parties agree to first try to resolve any dispute informally by contacting each other directly.
Absent a separate arbitration agreement, disputes are subject to the exclusive jurisdiction of the courts referenced in the Governing Law section above.
15. Force Majeure & Third-Party Dependencies
Alithic’s services depend on third-party infrastructure — telephony carriers, cloud hosting, and AI model providers — that Alithic does not control. Alithic is not liable for delays, errors, or outages caused by the failure of these third-party systems, or by events beyond Alithic’s reasonable control, though Alithic will make reasonable efforts to notify affected clients and restore service.
16. Severability & Entire Agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms — together with a client’s Service Agreement, where one exists — are the entire agreement between the parties on this subject, and supersede any prior discussions on the same topics.
17. Changes to These Terms
These terms may change. The current version is always the one published on this page, and the date at the top reflects the last revision.
